Federal law, however, allows doctors to prescribe drugs that the FDA has approved for one indication for any other indication, even though the FDA never evaluated the safety or efficacy of the drug for that use.

March Madness Is Legal Madness: Can Your Bracket Survive Gambling Law?

March Madness Is Legal Madness: Can Your Bracket Survive Gambling Law?

March Madness is such a phenomena, it has developed its own lingo with terms such as “Win and You’re In,” “The Big Dance,” “Selection Sunday,” “Survive and Advance,” “Sweet Sixteen,” “Elite Eight,” and “Final Four.” But what does this all mean for fans? For fans, March Madness is the chance to win by filling out a tournament bracket. While “bracketology” (the process of predicting the field in the tournament through a bracket) might sound very scientific, it is quite chance-based and thus subject to gambling law inquiries.

Will The NFL Pay A Billion Dollars To Players With Brain Injuries?

Recently, more than 4,500 former NFL players have joined a class action lawsuit against the NFL. Many of these former players suffer from dementia, depression, or even Alzheimer’s. According to NFL.com, these players alleged that the NFL concealed the concussion problem and further exacerbated it by rushing players back onto the field. Moreover, the players alleged that the NFL benefited from the concussion dilemma by “glorifying and profiting from the kind of bone-jarring hits that make for spectacular highlight-reel footage.” The NFL vehemently denied the allegations.

Netflix, Comcast, And Net Neutrality

Netflix, Comcast, And Net Neutrality

This past weekend I attended panel discussion on careers in the entertainment industry. During the discussion I asked the three panelists their thoughts on Net Neutrality. Two of the panelists, who work at start-ups, responded that it was not something they were thinking about at the moment. The third panelist, who works for a corporation, was well informed. To me, this seemed to highlight the general issue. Corporations are thinking about this — while startups, who may be affected most, are not.

What Is “Soft IP” And Why Is It As Important As “Hard IP”

What Is “Soft IP” And Why Is It As Important As “Hard IP”

Last January, in my International Intellectual Property seminar, I heard the terms “Hard IP” and “Soft IP” for the very first time. When I heard these terms, I thought absolutely nothing of it. I had absolutely no opinion. I simply took it at face value: This is what the industry calls things, plain and simple.

Sadie Hawkins v. The Twenty-First Century

Sadie Hawkins v. The Twenty-First Century

Recently while I was in class, invitations were handed out for a school sanctioned “Sadie Hawkins” dance. For those who had never heard of Sadie Hawkins, it was described as an event where “girls have to ask boys.” Invite cards were individually distributed to each female student -- deliberately skipping the boys. At first glance, the Sadie Hawkins "theme" is harmless, but further consideration reveals that it is an antiquated and discriminatory practice.

Is Your Face In A Video Game?

Is Your Face In A Video Game?

When I first stumbled across the game “The Last of Us” I was surprised at how familiar the character Ellie was. That’s when I realized that Ellie looked a lot like Ellen Page. What makes this an even stranger scenario is the fact that Page is coincidentally the star of Quantic Dream’s “Beyond Two Souls.” Page was asked about her likeness to Ellie on Reddit’s “Ask Me Anything” session in which a fan asked “Have you seen any footage of ‘The Last of Us’ and would you have taken the role as Ellie if approached?” Page responded...

Is The Hollywood Reporter Your New Hot Fashion Source?

The film and fashion industries become increasingly and notably intertwined as they evolve. The fashion industry uses the same selling and marketing techniques as the Hollywood studios--the power of celebrity. Anna Wintour had the sensibility to replace models with popular actresses on the covers of Vogue, thereby increasing sales. The Hollywood Reporter (HR) is now returning the favor by having launched Pret-a-Reporter. Capitalizing on the trend of fashion blogging and exposure through social media, the site is dedicated to fashion and entertainment and is backed by big names and deep pockets.
